The Chapter 7 means test is a federal screening process under Bankruptcy Code Section 707(b). It determines whether your income is low enough to qualify for Chapter 7 liquidation bankruptcy or whether the law presumes you can repay creditors under Chapter 13. How the Two-Part Means Test Works

The calculation runs in two stages. First, your Current Monthly Income (CMI) is determined by averaging your gross income over the six months before filing, then annualizing that figure. CMI is then compared to the California median income for a household of your size, published by the U.S. Trustee Program using Census Bureau data.

Stage One: Comparing Income to the California Median

If your CMI is at or below the California median for your household size, you pass the first stage and are presumed eligible for Chapter 7 without further calculation. If your income exceeds the median, the analysis continues.

Stage Two: Expense Deductions & Disposable Income

The second stage subtracts allowable expenses from your CMI: IRS National Standards for food, clothing, and personal care; IRS Local Standards for housing and transportation; secured debt payments; and certain actual expenses such as child support or care for a disabled family member. What remains is your disposable income. If that figure suggests you could repay a meaningful share of unsecured debt over five years, the law presumes Chapter 7 would be an abuse of the system, and Chapter 13 may be the more appropriate path.

We examine every element of your financial picture before completing the calculation: wages, self-employment and business income, rental income, recent changes to household size, and any uncommon income sources that could affect the result.
