When am I entitled to bring a personal Injury Claim?
Under California law, if you are injured or your property is damaged as a result of another person or entity's negligence (or as a result of a defective product), you are entitled to bring a personal injury action against that person or entity.
In a personal injury case, what will I be compensated for?
In a personal injury claim, you are entitled to be compensated for your: (1) medical bills, including any physical therapy and/or chiropractic care; (2) medication; (3) any lost wages or loss of earnings (including future loss of earnings if you are disabled); and (4) pain and suffering, including emotional distress and inconvenience.
How will I pay for my medical bills if I do not have health insurance?
If you do not have health insurance that will pay your doctor bills, our law firm will refer you to a health care provider in your immediate area. We have referred clients to doctors from San Diego to Ventura. The health care providers will treat you on a medical lien basis. What this means is that doctors will be paid when the personal injury claim settles. By handling the claim in this fashion, the injured client does not have to pay any money out of pocket for his/her health care.
How much will I receive for pain and suffering & emotional distress?
Insurance Companies evaluate claims on a case by case basis. Cases involving broken bones, scars and major back problems, such as a herniated disc, will settle for substantially more than a soft tissue injury case (strain and sprain of the neck and/or back). The Law Offices of Joseph M. Tosti has settled in excess of $25,000,000 of claims since 1980 and Mr. Tosti will be happy to discuss with you what the potential or probable outcome of your claim might be.
How do I pay the attorney fees if I do not have any money?
Our law firm handles personal injury cases on a contingency fee basis. What this means is that you owe our firm nothing unless we obtain a recovery, settlement or verdict on your behalf. Although the attorney fee is typically 33 1/3% of the recovery if the case is settled prior to going to trial, the fee is negotiable. On certain cases, our law firm has been known to agree to a fee of 25%.
